Adoption

Adoption is a wonderful experience for everyone involved. It provides a family with a new member and a child with a loving home. However, the adoption process can be complex legally. Issues sometimes arise if a biological parent wants to be involved in the child’s life after the adoption.

At the Law Offices of W. Robert Montgomery in Denver, Colorado, we assist our clients with all aspects of an adoption to ensure that the experience is both joyous and trouble-free.

Stepparent and Grandparent/Relative Adoptions

Two of the most common types of adoption are stepparent adoptions and adoptions by relatives or grandparents.

Stepparent adoptions often provide a legal basis for a parent-child relationship that already exists. In stepparent adoptions, the biological parent is either missing or is no longer a part of the child’s life. For the stepparent adoption to take place, the biological parent must terminate his or her parental rights. To accomplish both steps, our lawyers combine an adoption proceeding with a petition to terminate parental rights.

Grandparents or relatives can serve as guardians of children in their care or can go through the adoption process to make the relationship permanent. There are many benefits to adoption. If you adopt a child, you can provide health insurance for the child under your employer’s health plan. Your child would also be entitled to inherit and can be a beneficiary under benefits such as life insurance and 401(k) plans.

We also assist same-sex couples during the adoption process in Colorado. To learn more, please visit our page on  same-sex adoptions.

Adoption is an involved process. Before an adoption, prospective parents must go though fingerprint checks with the Colorado Bureau of Investigation and the Federal Bureau of Investigation, a background check, a credit report and in some cases a home visit.
